Case: VINCO’S lawyers registered a trademark for a client that provides premium taxi services.
A trademark is a designation that distinguishes the goods and services of some persons from identical or related goods and services of others. Ownership of a trademark is certified by a certificate. The certificate grants its owner the exclusive right to prohibit others from using it without consent, unless otherwise provided by this Law
The trademark owner obtains the right to use the trademark to designate certain goods and services, the list of which is determined upon registration.
This means that the trademark owner may prohibit others from using identical trademarks and trademarks confusingly similar with respect to the same or homogeneous goods and services.
Challenges:
To determine the degree of similarity of trademarks, a patent attorney (and later a Ukrpatent expert) applies several criteria. The most important of them are:
- Visual similarity — how the trademark looks;
- Phonetic similarity — how the trademark is pronounced (sounds);
- Semantic similarity — what the trademark means;
- Scope of use — in respect of which goods and/or services the trademark is registered.
Result:
To register the trademark, our lawyers gathered all necessary information: a preliminary similarity search of trademarks, determination of the service class under the Nice Classification, and on 14 December 2020 filed an electronic application, paid the required fees, and on 31 August 2021 obtained a Certificate for a mark for goods and services.
