Trademark Registration
In today’s world of active business development and strong competition, a trademark is one of the key tools that allows a company’s goods or services to stand out among other market participants.
If consumers already know and recognize your brand, a trademark becomes an important intangible asset of the business. It helps protect business reputation, commercial identity, customer trust, and the results of investments in brand development.
Why Is Trademark Registration Important?
Trademark protection is territorial in nature. This means that a trademark is protected only in the country or region where it is registered.
If you are planning to start a business or already operate one and want to protect your brand from unfair competitors, it is advisable to file an application for trademark registration.
Trademark registration allows you to:
- secure rights to a name, logo, or other designation;
- prohibit others from using similar designations for identical or related goods and services;
- protect the brand in disputes with competitors;
- use the trademark as a business asset;
- transfer trademark rights, enter into license agreements, or franchise agreements;
- increase the investment attractiveness of the company.
Trademark Registration Timeline
Trademark registration is a procedure that consists of several stages and involves examinations of the application.
The average term for consideration of a trademark application in Ukraine may be around 18 months. The actual timeline depends on the workload of the IP Office, the correctness of the application, the number of Nice Classification classes, examination requests, preliminary refusals, third-party oppositions, and other circumstances.
The possibility of shortening the examination period or using additional procedures should be checked separately as of the application filing date.
For Which Goods and Services Is a Trademark Registered?
When registering a trademark, it is necessary to determine the specific goods or services for which it will be used. For this purpose, the Nice Classification of Goods and Services is applied.
The Nice Classification allows goods and services to be grouped into classes and defines the scope of legal protection of the trademark.
For example, if an entrepreneur provides advertising services, such services fall within Class 35 of the Nice Classification, which covers, among other things, advertising, business management, business administration, and office functions.
However, it is important not only to choose the class but also to correctly formulate the list of specific goods or services. If an entrepreneur is engaged exclusively in advertising activities, the application should include only those services in Class 35 that correspond to the actual business activities.
What Does the Choice of Class Affect?
The choice of Nice Classification class directly affects the scope of legal protection of the trademark.
In the event of a dispute, it will be taken into account for which goods or services the trademark is registered. If the list of goods and services is drafted incorrectly or too narrowly, it may complicate brand protection.
Incorrect selection of classes or inaccurate wording of the list of goods and services may lead to the following risks:
- refusal to register the trademark;
- limited scope of legal protection;
- difficulties in proving infringement;
- conflicts with owners of earlier registered trademarks;
- risk of early termination of the certificate for part of the goods or services due to non-use of the trademark.
That is why it is advisable to conduct a preliminary search and correctly determine the list of Nice Classification classes before filing the application.
Main Stages of Trademark Registration
The trademark registration procedure in Ukraine usually includes the following stages:
- Preliminary analysis of the designation and assessment of refusal risks.
- Determination of Nice Classification classes and preparation of the list of goods and services.
- Preparation of the application and necessary documents.
- Filing the application with the IP Office.
- Establishment of the application filing date.
- Formal examination.
- Substantive examination.
- Receipt of the decision based on the examination results.
- Payment of publication fees and state duty for issuance of the certificate.
- State registration of the trademark and issuance of the certificate.
How Are Official Fees for Trademark Registration Calculated?
The amount of official payments for trademark registration depends on several factors, including:
- the number of applicants;
- the number of Nice Classification classes;
- the form of filing — paper or electronic;
- whether the trademark is filed in color;
- whether the designation contains the official name or international letter code of the state of Ukraine;
- the need to pay the publication fee and state duty for issuance of the certificate.
As a general rule, trademark registration may involve the following payments:
- application filing fee for one Nice Classification class;
- additional fee for each further Nice Classification class;
- additional fee for a color designation;
- fee for publication of information on the issuance of the certificate;
- state duty for issuance of the certificate;
- additional fee if the designation contains the official name or international letter code of the state of Ukraine.
The final cost calculation depends on the specific application, the number of classes, the filing method, and the official fees applicable as of the filing date.
