Protecting a grain trader’s rights under an agrarian receipt

Case: Attorneys of law firm VINCO’S successfully defended the rights of one of Ukraine’s leading grain traders under an agrarian receipt.
Challenges:
The claims were based on the argument that the supplier had only partially performed the terms of the agrarian receipt, whereas the notarial endorsement covered the entire goods that were the subject of the contractual relationship.
However, VINCO’S attorneys rebutted the arguments in the statement of claim with the relevant provisions of special legislation and information obtained in response to attorney requests from various institutions while preparing the legal position.
It should be noted that the Client’s costs of professional legal assistance were reimbursed.
Result:
VINCO’S attorneys proved in court that there were no legal grounds to declare the notary’s writ of execution unenforceable.
After the proceedings conducted by our attorneys, the debtor approached our Client and agreed to compensate for the losses caused by its actions and to perform the principal obligation totaling UAH 2.7 million.
