Registration of a Political Party in Ukraine
A political party is not merely a civic initiative. It is a complex legal and organizational project that requires proper preparation of documents, compliance with statutory requirements, and successful completion of the state registration procedure.
VINCO’S Legal Company provides legal support for the establishment of political parties, prepares statutory documents, assists with the organization of the founding congress, supports the legal aspects of collecting signatures, and prepares documents for submission to the Ministry of Justice of Ukraine.
What Is a Political Party?
A political party is a voluntary association of Ukrainian citizens registered in accordance with the law and united by support for a specific nationwide program of social development. Its purpose is to facilitate the formation and expression of citizens’ political will, participate in elections, and engage in other political activities.
Political parties in Ukraine are established and operate only with all-Ukrainian status. Therefore, when creating a party, it is necessary to consider not only the central governing structure but also the future regional network.
Who Can Be a Member of a Political Party?
Only a citizen of Ukraine who has the right to vote in elections may be a member of a political party. A citizen of Ukraine may be a member of only one political party at a time.
The law also establishes membership restrictions for certain categories of persons, including judges, prosecutors, police officers, military personnel, employees of the Security Service of Ukraine, tax and customs officers, civil servants in cases provided by law, and certain other categories.
Restrictions on Political Party Activities
When preparing a party program, charter, and symbols, it is necessary to comply with statutory restrictions. The establishment and activities of a political party are prohibited if its program goals or actions are aimed, among other things, at eliminating the independence of Ukraine, violently changing the constitutional order, violating sovereignty or territorial integrity, undermining state security, or promoting war, violence, or hostility.
Political parties are prohibited from having paramilitary formations. The creation and activities of party structural units within executive or judicial authorities, local self-government executive bodies, military formations, state-owned enterprises, educational institutions, and other state institutions and organizations are also prohibited.
Main Stages of Political Party Registration
Stage 1. Initial Consultation and Registration Strategy
At the first stage, the political concept, organizational structure, governing bodies, membership approach, regional development model, financing, reporting, and internal control mechanisms are determined.
It is important to assess not only the possibility of registering the party but also its future operation: participation in elections, development of regional organizations, financial reporting, membership contributions, and public communications.
Stage 2. Preparation of the Charter and Program
A political party must have a charter and a program. The program defines the party’s goals, objectives, and ways to achieve them. The charter regulates the organizational structure, membership procedures, governing bodies, congresses, financial control, audit, reorganization, and liquidation.
Special attention should be paid to internal party democracy, decision-making procedures, financial control, and gender representation quotas in electoral lists if the party plans to participate in elections.
Stage 3. Preparation of the Founding Congress
A political party is created by a group of at least 100 Ukrainian citizens. The decision to establish a political party is adopted at a founding congress, conference, or meeting.
At the founding event, the party’s charter and program are approved, governing and audit bodies are elected, representatives authorized to carry out registration actions are appointed, and a decision is made to organize the collection of signatures of Ukrainian citizens in support of the party’s creation.
Stage 4. Collection of Signatures
The decision to establish a political party must be supported by signatures of at least 10,000 Ukrainian citizens who have the right to vote in elections. The signatures must be collected in compliance with the territorial requirements established by law.
Signature collection is one of the most complex practical stages of party creation. It is important to properly prepare signature sheets, verify signatory data, comply with the form approved by the Ministry of Justice of Ukraine, and minimize the risk of signatures being rejected.
Stage 5. Preparation and Submission of Documents to the Ministry of Justice
State registration of a political party is carried out by the Ministry of Justice of Ukraine. Documents may be submitted personally by the applicant, through an authorized representative, or by registered mail.
After submission, the Ministry of Justice reviews the documents for compliance with the Constitution of Ukraine, the Law of Ukraine “On Political Parties in Ukraine,” the Law of Ukraine “On State Registration of Legal Entities, Individual Entrepreneurs and Public Formations,” and other regulations.
Stage 6. Registration and Entry into the Unified State Register
After a positive decision is made, information about the political party is entered into the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Formations. From that moment, the political party acquires legal entity status.
Stage 7. Registration of Regional Organizations
After state registration of the party, it is necessary to organize the work of its regional, city, district organizations, primary branches, or other structural units provided for by the party charter.
Within six months from the date of registration, the political party must ensure the establishment and registration of its regional organizations in the majority of regions of Ukraine, as well as in Kyiv, Sevastopol, and the Autonomous Republic of Crimea in accordance with the law. Practical implementation of this requirement during martial law and temporary occupation of certain territories requires separate legal analysis.
Documents Required for Political Party Registration
The following documents are usually prepared and submitted for state registration of a political party:
- application for state registration of a legal entity;
- charter of the political party;
- program of the political party;
- minutes of the founding congress, conference, or meeting;
- register of citizens who participated in the founding congress, conference, or meeting;
- list of signatures of Ukrainian citizens supporting the establishment of the political party in the prescribed form;
- information on the party’s governing bodies;
- information on the person or persons authorized to represent the party for registration actions;
- document confirming payment of the administrative fee or payment details;
- optional application for inclusion in the Register of Non-Profit Institutions and Organizations.
Registration Term and Official Fee
The review period for documents submitted for state registration of a political party is 30 working days. If necessary, this period may be extended, but by no more than 15 days.
The administrative fee for state registration of a political party is 140 subsistence minimums for able-bodied persons established by law as of 1 January of the calendar year in which the documents are submitted, rounded to the nearest UAH 10.
|
Current as of 2026 The subsistence minimum for able-bodied persons from 1 January 2026 is UAH 3,328. Therefore, the administrative fee for registering a political party in 2026 is UAH 465,920. |
Why Is Legal Support Important?
Registration of a political party is one of the most complex procedures in the area of public formations. Mistakes in the charter, program, founding congress minutes, signature sheets, or governing structure may result in refusal of state registration.
Special attention must be paid to the compliance of the program and symbols with statutory restrictions, proper formalization of the founding congress decisions, legality of signature collection, and preparation of the party’s financial and organizational model.
