Website and Website Content Copyright Protection

Quick overview

A corporate website, e-commerce store, online platform or information portal is more than a domain name and a collection of web pages. It may contain original text, design, photography, illustrations, video, software code, databases and other creative assets. These materials can have substantial commercial value and require a clear legal ownership structure.

Copyright arises automatically when an original work is created in an objective form; state registration is not a condition for protection. Nevertheless, registration of specific works can help document claimed rights, identify the protected material and strengthen the right holder’s evidentiary position in the event of copying, a dispute with a developer or unauthorised reuse of content.

VINCO’S Legal Company helps businesses identify the copyright-protected elements of their websites, secure ownership, prepare applications for the Ukrainian IP Office and establish a practical strategy to protect websites against copying.

Can an Entire Website Be Registered as a Single Work?

Under Ukrainian law, a website is a structured collection of interconnected digital data that may include different copyright works. This does not mean that every website automatically qualifies as one indivisible work covered by a single registration certificate.

Depending on its structure, it may be appropriate to register individual written works, software, graphic design, photographs, databases or an original selection and arrangement of materials where the requirements for a protected compilation are met. The rights in individual components remain with their respective right holders.

Before filing, we review the structure of the website, identify which assets require priority protection and determine what can properly be submitted under each application.

  • Original web-page text, blog articles, service descriptions, editorial selections and other written works.
  • Original graphic elements, illustrations, banners, icons, custom layouts and design materials.
  • Photographs, videos and other audiovisual works created for the website.
  • Computer programs, original source code, modules and software solutions in their specific expression.
  • Databases whose selection or arrangement meets the applicable intellectual-creation requirement.
  • An original creative selection and arrangement of content that qualifies as a protected compilation.
  • Original artistic elements of a logo, where applicable; trademark protection should be considered separately for the brand.

Copyright protects the specific original expression of a work, not a general website concept or its functionality. Similar layouts, business models or service features do not automatically establish infringement.

  • The abstract idea of an online store, marketplace, platform or digital service.
  • A sales method, business model, operating principle or function as such.
  • Common facts, generic wording and standard technical solutions.
  • A domain name as such: domain rights and rights in website content are separate matters.
  • A standard template or third-party component for which the site owner has no copyright.

For a product, company or service name and its logo used commercially, separate trademark protection may also be appropriate.

Paying for development, receiving administrator credentials or obtaining the project files does not necessarily establish ownership of every economic copyright right. Ownership depends on who created each asset, when it was created, the applicable legal rules and the terms of the relevant contracts.

  • Agreements with a development studio, freelance developer or contractor.
  • Employment agreements, job duties and rules governing employee-created works.
  • Clauses transferring or licensing rights in code, design, text and other deliverables.
  • Delivery and acceptance documents, specifications and lists of transferred assets.
  • Licences for CMS software, plugins, libraries, open-source components, fonts, templates and stock media.
  • Agreements with copywriters, photographers, illustrators, marketing agencies and other contributors.

VINCO’S reviews the chain of title from individual creators and contractors to the business, identifies gaps and prepares documents to resolve them. State registration alone cannot remedy a defective rights-transfer arrangement.

How Can You Protect Website Text and Images from Copying?

Written content, photographs and graphic assets are frequently reused without permission on competing websites, marketplaces and in advertising. A sound response starts by identifying the right holder, preserving source files and creation records, and considering state registration for commercially important works.

For imagery, stock-library licence terms and permissions from photographers or designers also need to be checked. Publishing a picture on your website does not automatically make your company its copyright owner.

How Can Website Design and Source Code Be Protected?

Original graphical elements and creative design may qualify for copyright protection as the relevant type of work. Software code is protected as the expression of a computer program or its original parts, but copyright does not confer a monopoly over abstract algorithms, functions or technical principles.

For software registration in Ukraine, an applicant may submit the source text or selected excerpts sufficient to identify the program, together with a description. The applicant may select the excerpts with due regard to confidentiality. For graphic works, copies must be prepared in the format required for the relevant category.

Using a pre-built theme, CMS or third-party library under a licence does not make the business the copyright owner of those components. The position should be checked before registration, fundraising or a sale of the website.

There is no general obligation to register before publication. Both published and unpublished works may be registered. Before launch, it is particularly useful to document ownership with developers, designers and content creators, preserve the completed deliverables and prioritise assets for registration.

How Can You Prove That Your Website Was Copied?

Finding a similar page is not enough. Effective enforcement requires identification of the protected work, evidence of ownership, a comparison of the specific materials and proper preservation of evidence of the suspected infringement.

  • Preserve source code, design files, original images, drafts, version history and project correspondence.
  • Collect development agreements, acceptance records, licences and other ownership documents.
  • Record URLs, dates of discovery, content copies, screenshots and other available digital evidence.
  • Arrange technical analysis, expert comparison or additional evidence preservation where appropriate.
  • Distinguish protected expression from general ideas, standard templates and lawfully licensed components.

What Should You Do if Another Website Copies Your Content?

The appropriate response depends on the infringement and the jurisdiction of the relevant service. After reviewing the evidence, a right holder may send a cease-and-desist demand, use an applicable platform or hosting-provider complaint process, request removal of the material and, where necessary, pursue the remedies available through court proceedings.

Where supported by the facts, related issues such as unfair competition, trademark infringement or misuse of confidential information may also require attention.

The application package depends on the category of the work. Requirements for copies of written works, graphic works, software and databases differ.

  • The prescribed application form completed in Ukrainian.
  • Details of the author or co-authors, applicant and right holder.
  • The title and copy of the work in the required format for its category.
  • Information on publication and documentary evidence of its date, if available.
  • Documents establishing economic rights where the applicant is not the author.
  • Documents concerning employee-created or commissioned works, where relevant.
  • Proof of the representative’s authority, if a representative is involved.
  • Proof of payment of the applicable official state fee.

The standard review period for a properly filed state copyright registration application before the Ukrainian IP Office is 30 calendar days. The overall process may take longer if deficiencies must be corrected or additional documents are requested.
