Copyright Registration for Photographs in Ukraine
Photographs are widely used in advertising, e-commerce, social media, news media, websites, catalogues, books and business presentations. For a photographer, a photograph is the result of creative work; for a business, it may be a valuable visual asset. Where images are copied, resold or used without permission, ownership of economic copyright and the ability to prove it are crucial.
An original photographic work is protected by copyright from the moment of its creation. State registration is not mandatory, but a registration certificate can document a particular photograph and the rights claimed in it. It may support licensing, negotiations and enforcement but does not replace contracts or evidence of creation.
VINCO’S Legal Company assists with copyright registration for photographs in Ukraine, rights clearance for photographers, agencies and customers, and enforcement against unauthorised use.
Which Photographs Are Protected by Copyright?
Ukrainian copyright law protects photographic works that meet the originality requirement. Creative choices may include camera angle, lighting, composition, timing, framing and other individual decisions.
- portraits, family, wedding and event photography;
- product, e-commerce and advertising photographs;
- fashion, beauty and studio photography;
- architecture, interior and landscape photography;
- editorial, documentary and fine-art photography;
- original images for websites, catalogues, social media and marketplaces;
- photo series and creatively arranged photo collections, depending on the work.
Not every image automatically qualifies as a protected photographic work: photographs without sufficient originality are not protected as such. The subject of the photograph alone does not determine copyright ownership.
Who Owns Copyright in a Photograph?
The author of a photographic work is the individual who created it through their own creative activity. The photographer retains personal moral rights, while economic rights may remain with the photographer or pass to another person or company by law or under an agreement.
Delivering JPEG, RAW or TIFF files, providing prints or paying for a photo shoot is not the same as assigning all economic copyright. For commissioned and employee-created photography, the type of work, applicable legal rules and the contract must all be considered.
- which photographs and final edits are covered by the agreement;
- whether economic rights are assigned or a licence is granted;
- use in advertising, websites, catalogues, social media and marketplaces;
- rights to edit, crop, share with partners or sublicense the images;
- territory, duration, and exclusive or non-exclusive licensing;
- the photographer’s right to use the photographs in a portfolio;
- RAW files, confidentiality and delivery arrangements.
Can a Photographer Publish Client Photos in Their Portfolio?
This depends on ownership, the agreement with the customer and the rights of identifiable people depicted in the photographs. Even where the photographer retains economic copyright, publishing a private photo shoot may require the subjects’ consent. Corporate shoots may also be subject to confidentiality obligations.
The agreement should expressly address the photographer’s use of the photographs in a portfolio, on social media, in competitions and in self-promotional materials.
Photography Copyright vs Consent to Use a Person’s Image
A photographer’s copyright and an individual’s rights concerning their own likeness are separate legal matters. Owning copyright in a portrait does not automatically permit unrestricted advertising use or public distribution.
Under Articles 307–308 of the Civil Code of Ukraine, consent to being photographed and consent to public use of the resulting image must be assessed separately, taking into account statutory exceptions, the circumstances of the shoot and the intended use. For commercial campaigns, an appropriate model release is advisable; personal-data requirements should also be considered where applicable.
Can Several Photographs Be Registered Under One Certificate?
The Ukrainian IP Office requires each copyright registration application to concern one work. Separate photographs will therefore generally require separate applications. Where a photo book or collection reflects original selection or arrangement, it may qualify as a compilation in its own right.
Registering a compilation does not automatically register copyright in every individual photograph it contains. We assess the appropriate filing strategy based on the images, their commercial value and the intended scope of protection.
When Should You Register Copyright in Photographs?
- before licensing or selling commercially valuable images;
- before supplying work to an advertising agency, publisher or major customer;
- where original product photographs are frequently copied by competitors;
- where an image library is an important asset for a photographer or studio;
- to document a particular completed work before large-scale publication;
- when preparing for international commercial exploitation;
- as supporting evidence in a dispute involving unauthorised use.
What Is Needed to Register a Photograph?
A state copyright registration application for a photographic work includes a prescribed form, a copy of the work and relevant supporting documents. For electronic filing, the Ukrainian IP Office accepts photographic copies in JPEG, TIFF or PNG format.
- an application completed in Ukrainian;
- details of the author, applicant and right holder;
- the title and a copy of the photographic work;
- creation and, where applicable, publication information;
- documents showing transfer of economic rights where the applicant is not the author;
- employment or commissioning documents where relevant;
- a power of attorney or other evidence of representation where applicable;
- proof of payment of the applicable official state fee.
How Long Does Photography Copyright Registration Take?
Under the rules effective from 3 November 2025, the standard review period for a properly prepared application before the Ukrainian IP Office is 30 calendar days. Requests to correct deficiencies or provide further documents may extend the overall procedure.
How Can You Protect Your Photos Against Online Copying?
If a photograph is used without permission on a website, in social media, advertising or a marketplace, preserve evidence of authorship, ownership and the use in question. Relevant material may include source files, metadata, editing records, contracts, publication history and properly preserved evidence from the infringing page.
Possible next steps include a cease-and-desist letter, a demand for removal, a platform or hosting-provider complaint, licence negotiations or court proceedings. Watermarks and © notices can identify a claimed right holder, but they do not themselves create copyright.
