Obtaining Critical Enterprise Status

Critical enterprise status is important for the subsequent reservation of conscription-liable employees, preservation of key personnel and stable business operations during martial law. However, the mere fact that a company performs important work does not automatically guarantee a positive decision. The competent authority, applicable criteria, supporting evidence and legal justification must be prepared correctly.

When This Status May Be Needed

This status may be relevant when a company performs an important economic, defence, infrastructure, manufacturing, logistics, medical, energy, agricultural, construction or other socially significant function and needs to retain key employees.

  • the company plans to reserve conscription-liable employees;
  • the company provides critical services, production, supplies or works for the state, a community or the defence sector;
  • the business operates in a sector covered by approved industry or regional criticality criteria;
  • the company has significant tax payments, foreign currency revenue, employees or a confirmed role in its sector;
  • the organization already had critical status and needs to confirm or renew it;
  • the company received a refusal or risks losing the status because of updated criteria or a compliance review.

What Critical Enterprise Status Means

Critical enterprise status is an official decision of an authorized public authority or military administration confirming that the enterprise meets the established criteria and is important for the economy, public livelihood or the needs of the Armed Forces and other military formations.

The status itself does not automatically reserve all employees. It is a legal prerequisite for the next stage – submitting employee lists for reservation under the applicable procedure. Therefore, the possibility of obtaining the status and the real possibility of reserving specific employees should be assessed together.

Criteria to Be Checked

The criteria depend on the type of enterprise, sector, competent authority and legal basis for the application. In practice, the following areas are usually assessed:

  • amount of taxes, duties and social security contributions paid during the reporting tax year;
  • foreign currency revenue during the reporting tax year;
  • strategic importance for the economy and national security;
  • importance for a sector of the national economy or a territorial community;
  • absence of tax debt and social security contribution debt;
  • average salary level of employees;
  • applicable industry or regional criteria;
  • contracts, public contracts, defence orders or confirmed functions for critical infrastructure;
  • filing of tax reporting for the latest reporting period;
  • absence of factors that may undermine the company’s compliance or good faith.

Where the Application Is Filed

The application is filed with the authority responsible for the relevant sector or territory: a central executive authority, another public authority, a state administration body, or the relevant regional, Kyiv or Sevastopol city state or military administration. Defence-related enterprises, contractors, manufacturers or suppliers for the Defence Forces may be subject to a separate submission and approval logic.

Choosing the correct authority is essential. Filing with the wrong authority or relying on criteria that do not apply to the company can lead to refusal or loss of time.

  • certificate or extract confirming no tax or social contribution debt;
  • average salary and number of employees;
  • list of conscription-liable employees planned for reservation;
  • contracts, acts, invoices, counterparty letters, public contracts or other documents confirming the importance of the activity;
  • previous criticality decisions, reservation decisions, refusals or correspondence with public authorities, if any.

Common Reasons for Refusal

  • the company failed to confirm the required number of criteria;
  • documents were filed with the wrong authority;
  • the justification is too general and does not prove real critical importance;
  • supporting documents are missing or do not match the selected criterion;
  • tax debt, missing reporting or data inconsistencies exist;
  • the average salary does not meet current requirements;
  • NACE codes or registration data do not correspond to actual activities;
  • the company did not explain why specific employees are essential for its operations;
  • updated industry or regional criteria were not taken into account.

Connection with Employee Reservation

After obtaining the status, the company may proceed to the next stage – reservation of conscription-liable employees. This requires a separate check of the reservation limit, military registration data, employee eligibility, current registry data and absence of obstacles to reserving specific individuals.

A mistake at the critical status stage may affect the entire reservation process. Therefore, the documents should be prepared with the future list of employees in mind.
