  • a complaint, attorney request, or administrative claim must be prepared.

What discharge from military service means

Discharge from military service means termination of service on a statutory ground and issuance of the relevant personnel order. After discharge, the person may be transferred to the reserve or retired depending on health condition, age, and other circumstances.

The lawyer’s key task is to determine the correct legal ground, check whether the documents meet legal requirements, build the evidence base, and ensure that the report is considered through the proper procedure.

Important: the grounds and procedure differ for contract service members, mobilized service members, officers, and service members serving during a special period or martial law.

Common legal grounds for discharge

The grounds for discharge depend on the type and period of service. In practice, the most common groups of grounds include:

  • health condition: a military medical commission conclusion on unfitness or temporary unfitness with re-examination;
  • family circumstances: care for a child, a person with disability, an ill family member, or other statutory circumstances;
  • reaching the age limit for military service;
  • release from captivity if the person does not wish to continue service;
  • statutory circumstances connected with the death or missing status of a close relative;
  • grounds related to expiry of service term, contract or other special conditions;
  • other statutory grounds applicable to the specific category of service member.

Risks of acting without legal support

A self-prepared report may work if the ground is clear and documents are complete. However, in practice, the unit may not register the report, may orally state that discharge is impossible, may request additional documents, or may leave the report without a proper response.
