License for trade in tobacco products
Activities related to the production, wholesale or retail trade of tobacco products, tobacco raw materials, industrial tobacco substitutes, and liquids used in electronic cigarettes are subject to licensing in cases established by law.
For businesses selling cigarettes, hookah tobacco, cigars, cigarillos, heated tobacco products, or e-cigarette liquids, having a proper license is a mandatory condition for lawful operation.
VINCO’S Legal Company supports clients in obtaining, amending, expanding, terminating, and reissuing licenses in the field of tobacco product circulation. We help verify whether a business is ready for licensing, prepare the documents, file the application with the licensing authority, and support the procedure until an extract from the register is obtained.
When Is a Tobacco Products License Required?
A license is required for business entities that plan to operate in the circulation of tobacco products or related goods.
- retail trade in tobacco products;
- retail trade in liquids used in electronic cigarettes;
- wholesale trade in tobacco products;
- wholesale trade in tobacco raw materials or e-cigarette liquids;
- production of tobacco products;
- cultivation or fermentation of tobacco raw materials in cases provided by law;
- other operations with tobacco products for which licensing is mandatory.
Important! Selling tobacco products or e-cigarette liquids without a proper license may result in substantial financial sanctions, loss of the right to operate, and other negative consequences for the business.
What Products Are Covered?
Tobacco products and related categories may include, in particular:
- filter and non-filter cigarettes;
- cigars and cigarillos;
- smoking, pipe, snuff, chewing, or other types of tobacco;
- heated tobacco products;
- industrial tobacco substitutes;
- hookah smoking products containing tobacco or tobacco substitutes;
- liquids used in electronic cigarettes.
Before filing documents, it is important to correctly determine the type of product, the trading format, and the relevant license type, as this affects the list of documents, the amount of payments, the filing procedure, and the ongoing obligations of the business.
Which Authority Issues the License?
The licensing authorities in the field of tobacco product circulation are the bodies of the State Tax Service of Ukraine. Information on granted licenses is entered into the Unified Register of Licensees in the relevant field.
Currently, the licensing result is not a paper document in the traditional sense, but an entry in the register and an electronic extract.
Important! For retail trade, the license is linked to a specific place of trade. If a business has several retail outlets at different addresses, a separate license must be obtained for each place of trade.
Retail Trade in Tobacco Products
The most common request from businesses is obtaining a license for retail trade in tobacco products. Such a license is required for shops, kiosks, cafes, restaurants, gas stations, and other businesses selling such products to end consumers.
For a retail license, it is important to verify:
- the existence of a registered individual entrepreneur or legal entity;
- the correctness of business activity codes;
- the availability of a place of trade;
- ownership or lawful use of premises or a trading place;
- registration of a cash register or software cash register;
- correct indication of fiscal numbers in the application;
- compliance of the trading address with the information stated in the application;
- timely payment of license fees.
Retail licenses for tobacco products are granted for an indefinite period, and the fee is paid quarterly in equal instalments. The amount of the fee depends on the type of activity, the place of trade, and the minimum wage established as of 1 January of the relevant year.
Wholesale Trade and Production of Tobacco Products
Wholesale trade and production of tobacco products are more complex licensing areas, as they require more detailed document preparation, confirmation of material and technical resources, and compliance with special legal requirements.
For manufacturers, the following may be particularly important:
- availability of production premises;
- ownership or lawful use of equipment;
- registration of equipment information in relevant registers where required by law;
- compliance with technological, sanitary, fire safety, and other requirements;
- internal procedures for controlling production and product circulation.
For wholesale trade, it is important to properly confirm storage places, logistics, document flow, the origin of goods, and readiness to comply with tax and excise legislation.
Licensing Procedure
The licensing procedure usually includes the following stages:
- Initial consultation and determination of the relevant license type.
- Verification of the business entity, activity codes, tax status, and place of trade or production.
- Verification of cash register data and other technical information to be included in the application.
- Preparation of the application and supporting documents.
- Payment of the relevant license fee.
- Filing documents with the licensing authority.
- Communication with the State Tax Service in case of requests or clarifications.
- Obtaining the decision and extract from the Unified Register of Licensees.
- Transfer of the final document package to the client and consultation on further compliance.
As a general rule, the decision to grant or refuse a license is made within the period established by law after the licensing authority receives a properly prepared application and the required information.
What Documents May Be Required?
The list of documents depends on the license type and the specific business model. For retail trade, the following information is usually reviewed or prepared:
- information about the business entity;
- type of business activity for which the license is requested;
- address of the place of trade;
- information about the cash register or software cash register;
- documents confirming the right to use the premises or trading place;
- information about product storage places if they differ from the place of trade;
- payment documents confirming payment of the license fee;
- power of attorney or another document confirming the representative’s authority if documents are filed by a lawyer.
For wholesale trade or production, the document package may be broader and may require additional analysis of the company’s material and technical resources and internal processes.
Risks of Operating Without a License or With Documentation Errors
Licensing mistakes may create significant financial and operational risks for a business.
- penalties for trading or manufacturing without a license;
- claims from regulatory authorities;
- inability to lawfully sell goods;
- risk of license termination;
- suspension of retail outlet operations;
- problems with suppliers, landlords, or counterparties;
- risks caused by incorrect cash register data or incorrect address of the place of trade;
- difficulties in restoring business operations after violations are identified.
That is why, before filing documents, it is advisable to conduct a legal review of the entire business model: from activity codes and tax status to the trading address, cash registers, and internal document flow.
