Alcohol Trade License

Trading in alcoholic beverages is a regulated business activity that requires proper licensing. To legally sell alcohol in a store, restaurant, cafe, bar, hotel, catering establishment, or through online channels, a business must obtain the relevant license.

VINCO’S Legal Company assists clients with obtaining, amending, maintaining, and terminating alcohol trade licenses. We help assess the readiness of the business for licensing, prepare documents, submit the application to the State Tax Service, and avoid common mistakes that may result in refusal or fines.

When Is an Alcohol Trade License Required?

A license is required for businesses that plan to carry out retail or wholesale trade in alcoholic beverages. This applies to alcohol sales at retail locations, sales in hospitality establishments, and distance sales where special legal requirements are met.

  • retail sale of alcoholic beverages in a store or retail outlet;
  • sale of alcohol in a restaurant, cafe, bar, hotel, or other establishment;
  • sale of alcoholic beverages by a producer;
  • wholesale trade in alcoholic beverages;
  • sale of alcohol through several places of trade;
  • amendment of an existing license due to a change of address, cash register data, or other information.

Important. A retail alcohol trade license is granted for each separate place of retail trade. If a business operates several stores or establishments at different addresses, licensing issues must be analyzed separately for each place of trade.

The production and circulation of alcoholic beverages are regulated by special legislation, including Law of Ukraine No. 3817-IX. Due to regulatory updates, it is important not to rely on outdated approaches regarding the validity period of licenses, payment amounts, or the application procedure.

As of 2026, wholesale and retail alcohol trade licenses are granted indefinitely. At the same time, periodic payments apply: annually for wholesale trade and quarterly in equal parts for retail trade.

Requirements for the Place of Trade

Before filing the application, it is necessary to check whether the place of trade complies with legal requirements. For retail trade in alcoholic beverages, except for certain statutory exceptions, the trading area must be at least 20 sq. m.

Special attention should be paid to the registration of cash registers or software cash registers, the correct address of the place of trade, documents confirming the right to use the premises, and consistency between the actual activity, registered business activities, and tax model.

Beer, cider, perry, and certain other beverages may be subject to special rules. Therefore, it is advisable to conduct a legal review of the specific sales model before submitting documents.

Required Documents

The main document is the license application. It includes information about the applicant, the type of license, the place of trade, cash registers or software cash registers, payment information, and other data required for entry into the relevant register.

Depending on the situation, preparation for licensing may require:

  • information about the individual entrepreneur or legal entity;
  • address of the place of trade;
  • documents confirming the right to use the premises;
  • information about registered cash registers or software cash registers;
  • data on business activity codes and tax status;
  • payment information for the first license payment;
  • power of attorney or another authorization document if documents are submitted by a lawyer.

Liability for Trading Without a License

Trading in alcoholic beverages without the required license creates significant financial risks for a business. The law provides for a fine of 200% of the value of goods sold, but not less than three minimum monthly wages established as of January 1 of the relevant year.

Risks may also arise when sales are conducted through cash registers or software cash registers that are not reflected in the relevant register, when periodic payments are not made on time, or when alcohol is sold in violation of special restrictions.
